General Terms and Conditions of Sale

Article 1 — Purpose and scope

These General Terms and Conditions of Sale (GTC) govern all sales concluded between:

Hereinafter referred to as "the Seller"«

and any individual of legal age making a purchase on the site ubedelyss.fr, hereinafter referred to as "the Client".

Any order placed on the website implies full and unreserved acceptance of these Terms and Conditions. The Customer declares having read and accepted them before validating their order. The applicable Terms and Conditions are those published on the website at the time the order is placed.

Article 2 — Products

The products offered for sale on ubedelyss.fr are natural food powders intended for culinary use.

The essential characteristics of each product (composition, weight, nutritional values, storage conditions, best before date) are indicated on each product sheet as well as on the packaging.

The photographs illustrating the products are for illustrative purposes only and are not contractual. Minor variations in color or texture may exist from one batch to another, without this constituting a defect.

The products comply with current French and European regulations applicable to foodstuffs.

Article 3 — Price

Prices are shown in euros, inclusive of all taxes (VAT). The seller benefits from the VAT exemption threshold in accordance with Article 293 B of the French General Tax Code (CGI) — VAT not applicable.

The Seller reserves the right to change its prices at any time. Products are billed at the price in effect at the time the order is validated.

Article 4 — Order

4.1 — Ordering Process

The order is placed online following these steps:

  1. Select products and add to cart
  2. Checking the contents of the shopping cart
  3. Customer account identification or creation (or guest order)
  4. Enter the delivery address
  5. Choice of delivery method
  6. Choosing and confirming the payment method
  7. Order confirmation by email

4.2 — Order Confirmation

The sale is considered concluded upon receipt of the order confirmation email automatically sent by the website. This email summarizes the products ordered, quantities, total price, and delivery information.

4.3 — Product Availability

Product offers are valid while supplies last. In the event of total or partial unavailability after order confirmation, the Customer will be notified by email as soon as possible. A full refund will be issued if payment has already been processed.

4.4 — Modification and cancellation

Any request for modification or cancellation must be sent to contact@ubedelyss.fr as soon as possible. An order that has already been shipped cannot be cancelled — the Customer must then exercise their right of withdrawal (see Article 7).

Article 5 — Payment

5.1 — Accepted payment methods

Payment is made online via:

  • Bank card (Visa, Mastercard, CB)
  • PayPal

5.2 — Payment Security

Transactions are secured by the SSL/TLS protocol. Bank details are processed directly by our payment provider and are never stored on our servers.

5.3 — Billing

An invoice is available in the customer area and/or attached to the order confirmation email.

Article 6 — Storage and use of products

UbeDelyss products are food items. The Customer is advised to:

  • Follow the storage conditions indicated on the packaging (cool, dry place away from light)
  • Carefully reseal the packaging after each use
  • Respect the best before date (BBD) indicated on the product
  • Check the list of ingredients and allergens before consumption

The Seller cannot be held responsible for misuse or improper storage of the products after delivery.

Article 7 — Right of withdrawal

In accordance with Article L.221-18 of the Consumer Code, the Customer has a period of 14 calendar days from the date of receipt of his order to exercise his right of withdrawal, without having to justify his decision.

Conditions of practice:

  • The product must be returned not opened, in its original, undamaged packaging
  • The product must not have been used

Exclusions:
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to products unsealed or opened after delivery, since they cannot be returned for reasons of hygiene or health protection.

Exercising the right of withdrawal:
To exercise this right, the Client must notify their decision by email to contact@ubedelyss.fr before the expiry of the 14-day period. The return and refund procedures are detailed on our [Delivery & Returns] page.

Article 8 — Legal Guarantees

Regardless of any commercial warranty, the Customer benefits from the following legal guarantees:

Legal guarantee of conformity (Articles L.217-4 et seq. of the Consumer Code)
The Seller is obligated to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The Customer has two years from the date of delivery to take action.

Warranty against hidden defects (Articles 1641 et seq. of the Civil Code)
The Seller is liable for hidden defects in the thing sold which render it unfit for the use for which it is intended.

In the event of a non-conforming or defective product upon receipt, the Customer is asked to contact contact@ubedelyss.fr as soon as possible, attaching supporting photos.

Article 9 — Responsibility

The Seller cannot be held responsible:

  • Non-performance of the contract in the event of force majeure (natural disaster, strike, epidemic, supply shortage, etc.)
  • Indirect damages resulting from the use of the products
  • Site malfunctions attributable to a third-party provider or an external cyberattack

The Seller's liability is in any event limited to the amount of the order in question.

Article 10 — Intellectual Property

All elements of the ubedelyss.fr website (texts, images, logos, recipes, visuals) are the exclusive property of Solange PROTIN and are protected by intellectual property law. Any reproduction or use without prior written authorization is prohibited.

Article 11 — Personal Data

The data collected during the ordering process is subject to computer processing necessary for sales management and compliance with legal obligations. For more information, please consult our [Privacy Policy].

Article 12 — Consumer Mediation

In the event of a dispute that cannot be resolved amicably, the Customer may resort free of charge to a consumer mediator within one year of their written complaint to the Seller.

Article 13 — Applicable Law and Jurisdiction

These Terms and Conditions are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution before resorting to legal action. Failing that, the French courts shall have exclusive jurisdiction.
